Welcome to the News Brief Nigeria website (the “Site”). The Site is operated by Brief Media Consult Limited (“News Brief Nigeria”). The following terms and conditions of use (the “Terms”) govern your access to and use of the Site and the content, functionality, services and features offered on or through the Site (collectively the “Services”).

  1. Acceptance of Terms

By accessing and using the Site and/or the Services, you signify your agreement to these Terms. If you do not agree to any of these Terms, you may not access or use the Site or the Services. News Brief Nigeria reserves the right to modify or amend the Terms from time to time without notice. Your continued use of the Site or Services after any changes to the Terms constitutes your acceptance of the amended Terms. It is your responsibility to review the Terms regularly

2. Use of Content

a. Unless otherwise noted, all materials, including articles, images, illustrations, designs, icons, photographs, video clips, software and written and other materials that are part of the Site and/or Services (collectively, the “Content”) are copyrights, trade dress and/or other intellectual properties owned, controlled or licensed by News Brief Nigeria. All Content is protected by the Copyright Act, Cap C28, Laws of the Federation of Nigeria 2004.

b. The Site and Services are for your personal, non-commercial use only. You may print, download or store selected portions of the Content, provided you: (1) only use these copies of the Content for your own personal, non-commercial use; (2) do not copy or post the Content on any network computer or transmit, distribute, publish or broadcast the Content in any media; and (3) do not modify or alter the Content in any way, or delete or change any copyright or other proprietary notices. No right, title or interest in any of the Content is transferred to you as a result of any copying, downloading or printing of such Content.

c. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of or exploit in any way, in whole or in part, any of the Content, the Site or any related software without proper request or crediting the Site.

3. User Content

a. You are solely responsible for any comments, photos, profiles, messages, notes, text, information, music, video, advertisements, listings and other content that you upload, publish or display (hereinafter, “post”) on or through the Site, or transmit to other users (collectively the “User Content”).

b. You may not post, transmit, or share User Content on the Site that you did not create or that you do not have permission to post. You are prohibited from posting or transmitting to or from the Site any unlawful, infringing, threatening, harassing, defamatory, obscene, harmful, fraudulent, hateful, abusive, libelous, invasive of another’s privacy, vulgar, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law, as per Section 24 of the Cybercrimes (Prohibition, Prevention, etc) Act, 2015.

c. News Brief Nigeria may review User Content and may delete or remove any User Content in its sole discretion that it determines violates these Terms or is otherwise objectionable, in accordance with the National Broadcasting Commission Act, Cap N11, Laws of the Federation of Nigeria 2004. News Brief Nigeria is not responsible or liable for any User Content.

4. Copyright Notice & Take Down Policy

News Brief Nigeria respects the intellectual property rights of others. If you believe your copyright has been infringed on the Site, please send a written notice with the following information to this email (info@newsbrief.ng), in accordance with Section 15(2) of the Copyright Act: 

  • Your name, address, telephone number, and e-mail address;
  • A description of the copyrighted work that you claim has been infringed;
  • The exact URL or a description of where the alleged infringing material is located;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and 
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Upon receipt of a proper notice, News Brief Nigeria will expeditiously remove or disable access to the infringing material and shall notify the affected user of such removal or disabling in accordance with Section 15(3) of the Copyright Act:

  • If you believe your User Content was wrongfully removed due to a copyright claim, you may send a counter-notice to News Brief Nigeria with the following information:
  • Your name, address, telephone number, and e-mail address;
  • Identification of the material that was removed, including its location before removal; 
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;
  • Your consent to the jurisdiction of the Federal Court for the judicial district in which your address is located; and 
  • Your electronic or physical signature.

If News Brief Nigeria receives a valid counter-notice, it will promptly forward it to the party who submitted the original claim of copyright infringement. News Brief Nigeria will follow the ‘notice and takedown’ procedures under Section 15 of the Copyright Act.

5. Disclaimer of Warranties

YOUR USE OF THE SITE AND SERVICES IS ENTIRELY AT YOUR OWN RISK. THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NEWS BRIEF NIGERIA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND RELATING TO THE SITE AND SERVICES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, IN ACCORDANCE WITH SECTION 57 OF THE SALE OF GOODS ACT, CAP S1, LAWS OF THE FEDERATION OF NIGERIA 2004. 

NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM NEWS BRIEF NIGERIA OR THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. WITHOUT LIMITING THE FOREGOING, NEWS BRIEF NIGERIA DOES NOT WARRANT THAT THE SITE, SERVICES, CONTENT OR FUNCTIONS CONTAINED IN THE SITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability

IN NO EVENT SHALL NEWS BRIEF NIGERIA BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR SERVICES, IN ACCORDANCE WITH SECTION 68 OF THE SALE OF GOODS ACT.

7. Indemnification 

You agree to indemnify, defend and hold harmless News Brief Nigeria, its directors, officers, employees, agents, licensors, suppliers and any third-party information providers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation by you of these Terms, in accordance with Section 74 of the Companies and Allied Matters Act, Cap C20, Laws of the Federation of Nigeria 2004. News Brief Nigeria reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification, and in such case, you agree to cooperate with News Brief Nigeria’s defense.

8. Privacy Policy

News Brief Nigeria is committed to protecting your privacy. Please review our Privacy Policy which describes how we collect, use, share and protect personal information about you, in accordance with the Nigeria Data Protection Regulation 2019. The Privacy Policy is incorporated by reference into these Terms.

9. Applicable Law and Jurisdiction

These Terms shall be governed by the laws of the Federal Republic of Nigeria. You agree that any dispute arising out of or relating to these Terms or your use of the Site or Services will be subject to the exclusive jurisdiction of the competent courts located in Nigeria, in accordance with Section 251 of the Constitution of the Federal Republic of Nigeria 1999. 

10. Severability 

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remainder of these Terms shall remain valid and enforceable, in accordance with Section 3 of the Interpretation Act, Cap I23, Laws of the Federation of Nigeria 2004.

11. Termination

News Brief Nigeria may suspend or terminate your access to the Site, Services and/or User Account if News Brief Nigeria determines at its sole discretion that you have violated these Terms or that the access or use presents a security risk. News Brief Nigeria reserves the right to modify or discontinue the Site or Services with or without notice to you. News Brief Nigeria shall not be liable to you for any modification, suspension or discontinuance of the Site or Services. 

12. Changes to the Terms  

News Brief Nigeria reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or Services after any changes to the Terms have been posted will constitute your acceptance of the amended Terms.

13. Links to Third Party Sites

The Site may contain links to third party websites and services. Such links are provided for your convenience only. News Brief Nigeria does not endorse, control or take responsibility for third party websites or their content. News Brief Nigeria is not responsible for the availability of external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, services or other materials on or available from such sites or resources. Your use of third party websites and resources is at your own risk and subject to the terms and conditions of use for such websites and resources.

14. Copyright and Trademark

All content included on the Site, such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the property of News Brief Nigeria or its content suppliers and protected by Nigerian and international copyright laws, in accordance with Section 1 of the Copyright Act. The compilation of all content on the Site is the exclusive property of News Brief Nigeria and protected by Nigerian and international copyright laws. All trademarks, service marks, trade names, logos, and icons are proprietary to News Brief Nigeria. Nothing contained on the Site should be construed as granting any license or right to use any trademark displayed on the Site without the written permission of News Brief Nigeria.

15. Limitations on Linking and Framing 

You may establish a hypertext link to the Site provided that the link does not state or imply any sponsorship, endorsement by, or ownership by News Brief Nigeria. However, you may not, without prior written permission, frame or inline link any content from the Site, or incorporate into another website or other service any of our material, content or intellectual property, in accordance with Sections 1 and 2 of the Copyright Act

16. Modifications to Site and Services

News Brief Nigeria reserves the right to modify or discontinue, temporarily or permanently, the Site or any Services with or without notice to you. News Brief Nigeria shall have no liability for modifications to or discontinuance of the Site or Services.

17. Entire Agreement

The Terms constitute the entire agreement between you and News Brief Nigeria relating to your access to and use of the Site and Services. The Terms supersede any prior or contemporaneous representations or agreements.

18. Registration and Accounts 

If you wish to access certain restricted sections of the Site or Services, you may be required to register and create an account with News Brief Nigeria, providing complete and accurate information. You are responsible for maintaining the confidentiality of your account password and are responsible for all activities under your account, in accordance with Section 58 of the Cybercrimes Act 2015. You agree to immediately notify News Brief Nigeria of any unauthorized use of your password or account or any other breach of security. News Brief Nigeria shall not be liable for any loss or damage arising from your failure to comply with this section.

19. Newsletters and Emails

By registering with the Site or Services, you consent to receive periodic newsletters, emails and other communications from News Brief Nigeria. You can unsubscribe from receiving emails at any time by clicking the “unsubscribe” link found at the bottom of News Brief Nigeria emails.

20. Right to Use Feedback

If you provide News Brief Nigeria with any feedback, suggestions, improvements, enhancements, modifications or other comments regarding the Site or Services, you grant News Brief Nigeria the right to use, disclose and exploit such feedback without restriction or any obligation to compensate you.

21. Assignment 

You may not assign, transfer or sublicense any of your rights under these Terms. News Brief Nigeria may assign these Terms without notice to you, in accordance with Section 257 of the Companies and Allied Matters Act.

22. Relationship of the Parties

Nothing in these Terms shall be deemed to constitute a partnership, joint venture, employment or agency relationship between you and News Brief Nigeria.

23. Force Majeure 

News Brief Nigeria shall not be liable for any failure to perform its obligations under these Terms if such failure results from any cause beyond News Brief Nigeria’s reasonable control, including mechanical, electronic or communications failure or degradation.

24. Severability

If any provision of these Terms is found to be invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect, in accordance with Section 3 of the Interpretation Act

25. Waivers

No waiver by News Brief Nigeria of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition.
